General Terms and Conditions for Trainings, Supervisions, Customized Seminars and Coachings

§1 Services of the Besser-Siegmund-Institut

As an organizer, the Besser-Siegmund-Institut conducts seminars, supervisions and customer-specific seminars (hereinafter collectively referred to as seminars) as well as coaching and online coaching. The services are provided by the seminar trainers, psychologists and coaches on their own responsibility. The Besser-Siegmund-Institute assumes no liability for the content and the manner of performance of the trainer or coach.

§2 Registration

Registration for seminars takes place via an online registration form or in writing, in the case of coaching sessions and online coaching sessions by telephone and e-mail as part of the individual appointment process. By sending the form/email or the coaching appointment commitment, the sender/coaching client agrees to the collection, processing and storage of his specified data. The data will be treated in accordance with the relevant provisions of the Federal Data Protection Act and used exclusively within the necessary framework. Data will only be passed on to third parties for advertising purposes with express permission. By sending this form, the sender agrees to receive e-mails from the Besser-Siegmund-Institut until revoked. The registration for participation in the seminar, coaching or online coaching is binding for the seminar participant/coaching client.

§3 Right of withdrawal exclusively for consumers for online coaching

Within the framework of distance selling law (coach and coachee do not meet in person for the conclusion of the contract), coaching customers can revoke their contractual declaration regarding online coaching (appointments, prices) in text form (e.g. letter, fax, e-mail) within 14 days without giving reasons. The period begins after receipt of this instruction in text form in the form of a link in the e-mail to these GTCs. To meet the revocation deadline, it is sufficient to send the revocation in time. The revocation is to be sent to:Besser-Siegmund-Institut GmbHMönckebergstrasse 1120095 HamburgFax: + 49 (40) 3252 849-17Email: coaching@besser-siegmund.de (hyperlink)If the time interval between the appointment for online coaching and the online coaching appointment is less than 14 days, the Besser-Siegmund-Institut will separately request the coachee by email according to § 356 para. 4 BGB (German Civil Code) to insist on an execution of the online coaching on the agreed date. The coaching client is informed in this mail that he or she thereby loses his or her right of withdrawal - provided that the service is provided in full.If the coaching client accepts this loss of the right of withdrawal by mail, the appointment and price agreement for online coaching is considered legally binding, even if the time interval between the appointment and the online appointment is less than 14 days.

§4 Participation requirements for seminars

For the participation in our seminars a stable mental and physical condition of the participants is required. If a participant is currently or has in the past been undergoing psychological and/or psychiatric treatment, participation in our seminars must be agreed upon in advance with the doctor or therapist treating the participant. For reasons of quality assurance, participants of the seminars will only receive their certificate if they attend at least 80% of the seminar time.

§5 Refusal and exclusion of participants

The Besser-Siegmund-Institut is entitled to reject participants before the seminar without giving reasons. In this case, seminar fees already paid will be refunded 100%. Participants who repeatedly or persistently disrupt the seminar and/or event process or misuse the seminar to recruit and/or entice away persons or offer third-party products for sale can be excluded from the seminar by the seminar leader. In this case, 100% of the seminar fee must be paid.

§6 Withdrawal, rebooking and substitute participantsa) Withdrawal

Your seminar place is firmly reserved as soon as your registration has been received and you have received confirmation of participation from us by e-mail. In case of cancellation after registration, we will charge the following fees after receipt of the written cancellation notice: up to 30 days before the first seminar: € 25.00 processing fee, up to 15 days before the start of the event: 50% of the fee for the first seminar, thereafter: the entire fee for the first seminar. The payment of the half or full seminar fee is waived if the place reserved for you in all seminars can be newly filled via our waiting list. In this case, there is only a processing fee of € 25.00. If you withdraw after the start of the training, we will charge a cancellation fee of 100% of the outstanding seminar fees for technical reasons, or the seminar place will be taken over by another qualified participant.In the case of short-term registrations, less than 14 days before the start of the seminar, the right of withdrawal does not apply. Rebookings are not possible in the case of short-notice bookings.b) Seminar cancellation insuranceThe Besser-Siegmund-Institut generally recommends that training participants take out seminar cancellation insurance. These services are not offered by the organizer itself. They can be taken out through external service providers.c) RebookingRebookings can be made up to 4 weeks before the start of the seminar. These will be charged at a flat rate of € 50.00. Rebookings can only be made once, the 14-day right of withdrawal after rebooking is excluded.The following rebookings are possible: A rebooking to a seminar of the same content at a later date within twelve months.    A rebooking to a seminar with a lower price, the price difference is not refundable.    A rebooking to a seminar with a higher price, the price difference has to be paid up (even with the same subject).Special events or individual seminars cannot be rebooked. When rebooking, the requirements for admission to the corresponding seminars must be met.d) Substitute participantsSubstitute participants can be named free of charge, provided that they meet the participation requirements and the requirements for admission to the corresponding seminars. Substitute participants must be notified immediately in writing to the Besser-Siegmund-Institut with all registration data.

§7 Cancellation by the organizer / cancellation of the trainerChange of venue / reduced internet quality

The seminar can be cancelled by the organizer, for example, due to insufficient number of participants, cancellation of the trainer due to accident or illness, or similar. The cancellation will be made in writing, if still possible, otherwise by e-mail or telephone. Payments already made will be refunded immediately by the Besser-Siegmund-Institut. Further claims for damages by the participant cannot be asserted.The Besser-Siegmund-Institut is authorized to use a qualified trainer other than the one named in the program for the seminar in question.If the venue is cancelled due to circumstances for which the organizer is not responsible (e.g. repairs, pandemic), the organizer reserves the right to select another venue for the training in the vicinity of the event (7 km radius).If the internet quality of online events is reduced due to circumstances for which the organizer is not responsible (disturbances in the internet and/or technical disturbances of the platforms involved), the full seminar price must still be paid. 

§8 Seminar documents & copyright, trademark protection

All documents, videos, data or audio CDs, website content, etc. provided by the Besser-Siegmund-Institute contain the copyright of the Besser-Siegmund-Institute. They are protected by law and copyright. The documents, videos, data carriers or audio CDs, contents of the website, etc. may not be passed on, published, reproduced or used for own seminars in any form without explicit and written permission, not even in part. Excluded are explicitly the data carriers that are handed out by the Besser-Siegmund-Institut in the Easy Weight course leader training, in the Magic Words trainer training, in the wingwave coach training and in the wingwave trainer training.

§9 Booking/ Reservation of Hotel Rooms

The participant is responsible for the reservation and booking of hotel rooms. Claims for compensation in case of cancellation or cancellation of the seminar for which the Besser-Siegmund-Institut is not responsible cannot be asserted.

§10 Booking/ Reservation of Flights, Train Tickets

The participant is responsible for the reservation and booking of flights and train tickets. Claims for compensation in the event of cancellation or cancellation of the seminar for which Besser-Siegmund-Institut is not responsible cannot be asserted.

§11 Payment

After receipt of the respective invoice, please pay exclusively by bank transfer to our account indicated on the invoice form (please indicate name, invoice number, seminar name and date). No cash or EC card payments will be accepted. For payments from abroad, please note the additional transfer fees that may apply for foreign transfers. For seminars, payment must be received by bank transfer to the Besser-Siegmund-Institut account 14 days prior to the start of the seminar. If the time between registration and the beginning of the seminar is less than 14 days, the full amount is due immediately. The receipt of the money on our account is decisive. The right to participate in the seminar exists only upon full payment of the invoice amount, if there is no other written agreement (e.g. payment in installments).

§12 Audio and Video and Photo Recordings

Video, photo and audio recordings of the seminar may only be made by the participants with the prior consent of the Besser-Siegmund-Institut. Private photos may be taken as long as this does not interfere with the course of the seminar. The publication of the photographs electronically, in print media and/or all other media also requires the written permission of the Besser-Siegmund-Institut. The legally prescribed rights to one's own image must be observed. In seminars, photo, video and audio recordings are sometimes made by the employees of the Besser-Siegmund-Institut or a person authorized by them to do so. By participating in the seminar, the participant gives his/her consent to the private and commercial use of these recordings. The training participant gives his consent that the training group photo may be used for advertising purposes in the social networks of the Besser-Siegmund-Institut. A claim for commission or other payments is generally excluded, unless otherwise agreed in writing in advance.

§13 Scientology

The trainers, coaches and psychologists hereby affirm in lieu of oath that they have never attended courses of Scientology and that the company does not work according to the technology/theses of L. Ron Hubbard. These declarations apply equally to sects of any kind.

§14 Miscellaneous

Additional agreements can be made by e-mail. Should individual agreements or the GTC as a whole be or become invalid, the invalid agreements shall be replaced by legally valid agreements that come closest to the invalid agreement(s). In case of doubt, the currently valid legal provisions shall always apply. Place of performance and jurisdiction for Besser-Siegmund-Institut is Hamburg /Germany for non-consumers. The language of correspondence is German.Supplementary regulations are made with the participant through separate contracts, e.g. the wingwave coaching contract , the on-site coaching contract or the training contract for the Easy Weight course leader.
